In Part
1 of this article we discussed the need for an assessment
strategy and in Part
2 we listed the elements of an assessment strategy.
In this part we look at legal issues associated with
a high stakes testing program.
We live in a litigious society. Any time
you initiate testing with consequences you need to be
prepared for the possibility that someone is going to
be unhappy with his/her results – and that someone
may decide that his/her best means of redress is in
the courts. Should that happen you may be called upon
to defend the validity of your testing program (not
